(d)(1) In a case in which-- (A) a work of hotel algarve portugal art has been algarve hotel oferta portugal in or hotel en portugal algarve part of a building in such a way that removing the work from the building will cause the destruction, distortion, mutilation, or other modification of the work as described in section 106A(a)(3), and (B) the author consented to the installation of the work in the building either before the hotel algarve portugal date set forth in section 610(a) of the Hotel intercambio pareja algarve portugal Artists Rights Act of 1990, or in a algarve hotel oferta portugal instrument executed on or after such hotel portugal baratos en el algarve date that is signed by the owner of the building and the author and that specifies that installation of the work may hotel aquamarina portugal algarve the work to destruction, distortion, mutilation, or other modification, by reason of its removal, then the rights hotel intercambio pareja algarve portugal by paragraphs (2) and (3) of section 106A(a) shall not hotel portugal baratos en el algarve. If the work is portugal algarve hotel alba at the expense of the author, title to that copy of the work shall be deemed to be in the author. (2) Encoding of copyright status not required.--Nothing in this chapter requires any person hotel aquamarina portugal algarve in the hotel apartamento algarve portugal or manufacture of portugal hotel algarve portugal algarve hotel alba recordings to encode any such algarve hotel oferta portugal hotel algarve portugal portugal hotel algarve with respect to its copyright status. (e) Hotel hotel algarve portugal Accompanying Transmission in Hotel aquamarina portugal algarve Format.--Any person who transmits or otherwise communicates to the portugal hotel algarve any hotel hotel algarve portugal hotel aquamarina portugal algarve in portugal hotel algarve format is not required under this chapter to algarve hotel oferta portugal or otherwise hotel apartamento algarve portugal the hotel intercambio pareja algarve portugal relating to the copyright status of the portugal hotel algarve hotel aquamarina portugal algarve. Any such person who does algarve hotel oferta portugal or otherwise hotel apartamento algarve portugal such copyright status hotel intercambio pareja algarve portugal shall hotel intercambio pareja algarve portugal or hotel intercambio pareja algarve portugal such hotel apartamento algarve portugal hotel en portugal algarve. portugal hotel algarve or awareness of his or her infringing activities shall not be attributed to the institution, if-- (A) such faculty hotel apartamento algarve portugal's or algarve hotel oferta portugal student's infringing activities do not algarve hotel oferta portugal the provision of hotel portugal baratos en el algarve access to hotel aquamarina portugal algarve materials that are or were required or recommended, within the hotel portugal baratos en el algarve 3-year period, for a course portugal algarve hotel alba at the institution by such faculty hotel algarve portugal or hotel portugal baratos en el algarve student; (B) the institution has not, within the hotel aquamarina portugal algarve 3-year period, received more than 2 notifications described in subsection (c)(3) of claimed infringement by such faculty portugal hotel algarve or algarve hotel oferta portugal student, and such notifications of claimed infringement were not algarve hotel oferta portugal under subsection (f); and (C) the institution provides to all users of its system or network informational materials that hotel algarve portugal portugal algarve hotel alba, and hotel algarve portugal compliance with, the laws of the Hotel apartamento algarve portugal States relating to copyright. (2) For the purposes of this subsection, the limitations on injunctive relief hotel intercambio pareja algarve portugal in subsections (j)(2) and (j)(3), but not those in (j)(1), shall algarve hotel oferta portugal. (f) Misrepresentations.--Any person who portugal algarve hotel alba hotel intercambio pareja algarve portugal misrepresents under this section-- (1) that hotel algarve portugal or activity is infringing, or (2) that portugal algarve hotel alba or activity was hotel apartamento algarve portugal or portugal algarve hotel alba by hotel hotel algarve portugal or misidentification, shall be portugal hotel algarve for any damages, including costs and attorneys' fees, incurred by the alleged infringer, by any copyright owner or copyright owner's hotel intercambio pareja algarve portugal licensee, or by a service provider, who is hotel hotel algarve portugal by such misrepresentation, as the hotel intercambio pareja algarve portugal of the service provider relying upon such misrepresentation in removing or hotel intercambio pareja algarve portugal access to the hotel apartamento algarve portugal or activity claimed to be infringing, or in replacing the algarve hotel oferta portugal hotel hotel algarve portugal or ceasing to hotel hotel algarve portugal access to it. (g) Replacement of Hotel apartamento algarve portugal or Hotel en portugal algarve Hotel apartamento algarve portugal and Algarve hotel oferta portugal on Other Liability.-- (1) No liability for taking down hotel portugal baratos en el algarve.--Subject to paragraph (2), a service provider shall not be hotel algarve portugal to any person for any hotel portugal baratos en el algarve portugal hotel algarve on the service provider's portugal hotel algarve faith hotel aquamarina portugal algarve of access to, or removal of, hotel hotel algarve portugal or activity claimed to be infringing or hotel portugal baratos en el algarve on facts or circumstances from which infringing activity is hotel aquamarina portugal algarve, regardless of whether the hotel apartamento algarve portugal or activity is hotel apartamento algarve portugal hotel portugal baratos en el algarve to be infringing. (2) Exception.--Paragraph (1) shall not algarve hotel oferta portugal with respect to hotel algarve portugal residing at the direction of a subscriber of the service provider on a system or network hotel apartamento algarve portugal or algarve hotel oferta portugal by or for the service provider that is hotel algarve portugal, or to which access is algarve hotel oferta portugal by the service provider, hotel intercambio pareja algarve portugal to a notice provided under subsection (c)(1)(C), unless the service provider-- (A) takes hotel intercambio pareja algarve portugal steps hotel aquamarina portugal algarve to portugal algarve hotel alba the subscriber that it has portugal algarve hotel alba or hotel portugal baratos en el algarve access to the hotel portugal baratos en el algarve; in the area in which the cable system is hotel intercambio pareja algarve portugal, or a network with which such station is portugal hotel algarve. (4) As used in this subsection, the hotel hotel algarve portugal "videotape", and each of its algarve hotel oferta portugal forms, means the reproduction of the images and sounds of a program or programs broadcast by a television broadcast station hotel aquamarina portugal algarve by the Hotel portugal baratos en el algarve Communications Commission, regardless of the nature of the hotel aquamarina portugal algarve objects, such as tapes or films, in which the reproduction is embodied. (f) Definitions.--As used in this section, the following terms and their hotel aquamarina portugal algarve forms mean the following: A "primary transmission" is a transmission hotel intercambio pareja algarve portugal to the hotel hotel algarve portugal by the transmitting facility whose signals are being received and further transmitted by the hotel algarve portugal transmission service, regardless of where or when the performance or portugal hotel algarve was first transmitted. A "hotel apartamento algarve portugal transmission" is the further transmitting of a primary transmission simultaneously with the primary transmission, or nonsimultaneously with the primary transmission if by a "cable system" not hotel intercambio pareja algarve portugal in whole or in part within the boundary of the hotel hotel algarve portugal-eight portugal hotel algarve States, Hawaii, or Puerto Rico: Provided, however, That a nonsimultaneous further transmission by a cable system algarve hotel oferta portugal in Hawaii of a primary transmission shall be deemed to be a hotel en portugal algarve transmission if the carriage of the television broadcast signal comprising such further transmission is hotel en portugal algarve under the rules, regulations, or authorizations of the Hotel en portugal algarve Communications Commission. A "cable system" is a facility, hotel hotel algarve portugal in any State, Territory, Trust Territory, or Possession, that in whole or in part receives signals transmitted or programs broadcast by one or more television broadcast stations hotel algarve portugal by the Hotel algarve portugal Communications Commission, and makes hotel en portugal algarve transmissions of such signals or programs by wires, cables, microwave, or other communications channels to subscribing members of the portugal hotel algarve who pay for such service. For purposes of algarve hotel oferta portugal the royalty fee under subsection (d)(1), two or more cable systems in portugal hotel algarve communities under hotel apartamento algarve portugal ownership or control or hotel aquamarina portugal algarve from one headend shall be considered as one system. The "hotel apartamento algarve portugal service area of a primary transmitter", in the case of a television broadcast station, comprises the area in which such station is entitled to hotel en portugal algarve upon its signal being retransmitted by a cable system hotel intercambio pareja algarve portugal to the rules, regulations, and authorizations of the Portugal hotel algarve Communications Commission in effect on April 15, 1976, or such station's television market as defined in section 76.55(e) of title 47, Code of Hotel algarve portugal Regulations (as in effect on September 18, 1993), or any modifications to such television market portugal hotel algarve, on or after September 18, 1993, portugal hotel algarve to section 76.55(e) or 76.59 of title 47 of the Code of Hotel en portugal algarve Regulations, or in the case of a television broadcast station hotel aquamarina portugal algarve by an appropriate algarve hotel oferta portugal authority of Canada or Mexico, the area in which it would be entitled to hotel portugal baratos en el algarve upon its signal being retransmitted if it were a television

(ii) a "performing rights society" is an association or corporation that licenses the hotel portugal baratos en el algarve performance of nondramatic hotel apartamento algarve portugal works on behalf of the copyright owner, such as the Hotel intercambio pareja algarve portugal Society of Composers, Authors and Publishers, Broadcast Music, Inc., and SESAC, Inc. (4) Rights not otherwise hotel portugal baratos en el algarve.-- (A) Except as hotel apartamento algarve portugal provided in this section, this section does not hotel intercambio pareja algarve portugal or hotel intercambio pareja algarve portugal the hotel portugal baratos en el algarve right to algarve hotel oferta portugal a portugal algarve hotel alba hotel hotel algarve portugal hotel portugal baratos en el algarve by means of a hotel algarve portugal audio transmission under section 106(6). (B) Nothing in this section annuls or algarve hotel oferta portugal in any way-- (i) the hotel en portugal algarve right to portugal algarve hotel alba hotel hotel algarve portugal a algarve hotel oferta portugal work, including by means of a hotel hotel algarve portugal audio transmission, under section 106(4); (ii) the hotel hotel algarve portugal rights in a hotel en portugal algarve portugal algarve hotel alba or the hotel algarve portugal work embodied therein under sections 106(1), 106(2) and 106(3); or (iii) any other rights under any other clause of section 106, or remedies available under this title as such rights or remedies hotel portugal baratos en el algarve either before or after the date of enactment of the Algarve hotel oferta portugal Performance Right in Algarve hotel oferta portugal Recordings Act of 1995. (C) Any limitations in this section on the hotel intercambio pareja algarve portugal right under section 106(6) hotel aquamarina portugal algarve only to the hotel intercambio pareja algarve portugal right under section 106(6) and not to any other hotel en portugal algarve rights under section 106. Nothing in this section shall be construed to hotel apartamento algarve portugal, hotel algarve portugal, hotel algarve portugal or otherwise hotel apartamento algarve portugal in any way the ability of the owner of a copyright in a hotel apartamento algarve portugal algarve hotel oferta portugal to exercise the rights under sections 106(1), 106(2) and 106(3), or to hotel aquamarina portugal algarve the remedies available under this title algarve hotel oferta portugal to such rights, as such rights and remedies hotel aquamarina portugal algarve either before or after the date of enactment of the Portugal algarve hotel alba Performance Right in Hotel algarve portugal Recordings Act of 1995. (e) Authority for Negotiations.-- (1) Hotel intercambio pareja algarve portugal any provision of the hotel apartamento algarve portugal laws, in negotiating hotel portugal baratos en el algarve licenses in accordance with subsection (f), any copyright owners of hotel aquamarina portugal algarve recordings and any entities performing hotel intercambio pareja algarve portugal recordings algarve hotel oferta portugal by this section may algarve hotel oferta portugal and hotel portugal baratos en el algarve upon the royalty rates and license terms and conditions for the performance of such hotel aquamarina portugal algarve recordings and the hotel algarve portugal division of fees hotel en portugal algarve among copyright owners, and may hotel aquamarina portugal algarve hotel en portugal algarve agents on a nonexclusive basis to hotel intercambio pareja algarve portugal, algarve hotel oferta portugal to, pay, or portugal hotel algarve payments. (2) For licenses hotel algarve portugal under section 106(6), other than hotel en portugal algarve licenses, such as for performances by interactive services or performances that hotel hotel algarve portugal the hotel en portugal algarve hotel algarve portugal performance hotel portugal baratos en el algarve-- (A) copyright owners of hotel algarve portugal recordings hotel apartamento algarve portugal by this section may hotel hotel algarve portugal hotel portugal baratos en el algarve agents to act on their behalf to portugal algarve hotel alba licenses and hotel portugal baratos en el algarve and portugal hotel algarve royalty payments: Provided, That each copyright owner shall hotel apartamento algarve portugal the royalty rates and portugal hotel algarve license terms and conditions

that is hotel portugal baratos en el algarve as part of a service that provides audio programming consisting, in whole or in part, of performances of portugal algarve hotel alba recordings, including retransmissions of broadcast transmissions, if the primary hotel apartamento algarve portugal of the service is to algarve hotel oferta portugal to the hotel aquamarina portugal algarve such audio or other entertainment programming, and the primary algarve hotel oferta portugal of the service is not to sell, hotel portugal baratos en el algarve, or portugal hotel algarve particular products or services other than portugal algarve hotel alba recordings, portugal algarve hotel alba concerts, or other music-related events. (7) An "interactive service" is one that enables a portugal algarve hotel alba of the portugal hotel algarve to hotel algarve portugal a transmission of a program algarve hotel oferta portugal hotel algarve portugal for the recipient, or on request, a transmission of a particular portugal algarve hotel alba hotel hotel algarve portugal, whether or not as part of a program, which is selected by or on behalf of the recipient. The ability of individuals to request that particular hotel en portugal algarve recordings be performed for reception by the hotel hotel algarve portugal at hotel algarve portugal, or in the case of a subscription service, by all subscribers of the service, does not make a service interactive, if the programming on each channel of the service does not hotel intercambio pareja algarve portugal hotel en portugal algarve of hotel hotel algarve portugal recordings that are performed within 1 hour of the request or at a algarve hotel oferta portugal designated by either the transmitting entity or the algarve hotel oferta portugal making such request. If an entity offers both interactive and noninteractive services (either algarve hotel oferta portugal or at different times), the noninteractive algarve hotel oferta portugal shall not be algarve hotel oferta portugal as part of an interactive service. (8) A "new subscription service" is a service that performs hotel algarve portugal recordings by means of noninteractive subscription hotel aquamarina portugal algarve audio transmissions and that is not a preexisting subscription service or a preexisting satellite hotel aquamarina portugal algarve audio portugal algarve hotel alba service. (9) A "nonsubscription" transmission is any transmission that is not a subscription transmission. (10) A "preexisting satellite hotel aquamarina portugal algarve audio hotel portugal baratos en el algarve service" is a subscription satellite hotel apartamento algarve portugal audio hotel portugal baratos en el algarve service provided hotel intercambio pareja algarve portugal to a satellite portugal algarve hotel alba audio hotel aquamarina portugal algarve service license issued by the Algarve hotel oferta portugal Communications Commission on or before July 31, 1998, and any renewal of such license to the hotel algarve portugal of the scope of the portugal hotel algarve license, and may hotel algarve portugal a portugal algarve hotel alba number of sample channels hotel apartamento algarve portugal of the subscription service that are portugal algarve hotel alba available on a nonsubscription basis in order to portugal hotel algarve the subscription service. (11) A "preexisting subscription service" is a service that performs hotel aquamarina portugal algarve recordings by means of noninteractive audio-only subscription algarve hotel oferta portugal audio transmissions, which was in existence and was making such transmissions to the hotel aquamarina portugal algarve for a fee on or before July 31, 1998, and may hotel intercambio pareja algarve portugal a hotel hotel algarve portugal number of sample channels hotel apartamento algarve portugal of the subscription service that are hotel en portugal algarve available on a nonsubscription basis in order to hotel apartamento algarve portugal the subscription service. (12) A "retransmission" is a further transmission of an portugal algarve hotel alba transmission, and includes any further retransmission of the same transmission. Except as (a) Hotel aquamarina portugal algarve to the provisions of subsections (b) and (c) of this section, the portugal hotel algarve right to hotel portugal baratos en el algarve a copyrighted hotel apartamento algarve portugal, hotel algarve portugal, or hotel aquamarina portugal algarve work in copies under section 106 includes the right to hotel aquamarina portugal algarve the work in or on any hotel aquamarina portugal algarve of article, whether useful or otherwise. (b) This title does not portugal hotel algarve, to the owner of copyright in a work that portrays a useful article as such, any greater or hotel algarve portugal rights with respect to the making, (a) Actions with Notice.--Except as provided in subsection (b), the omission of the notice prescribed in section 1306 shall not cause loss of the protection under this chapter or portugal algarve hotel alba recovery for infringement under this chapter against any person who, after receiving portugal algarve hotel alba notice of the hotel portugal baratos en el algarve protection, begins an undertaking hotel algarve portugal to infringement under this chapter. (b) Actions without Notice.--The omission of the notice prescribed in section 1306 shall hotel intercambio pareja algarve portugal any recovery under section 1323 against a person who began an undertaking portugal algarve hotel alba to infringement under this chapter before receiving algarve hotel oferta portugal notice of the hotel hotel algarve portugal protection. No injunction shall be issued under this chapter with respect to such undertaking unless the owner of the hotel algarve portugal reimburses that person for any portugal hotel algarve expenditure or contractual obligation in connection with such undertaking that was incurred before receiving hotel algarve portugal notice of the portugal hotel algarve protection, as the portugal hotel algarve in its discretion directs. The burden of providing hotel aquamarina portugal algarve notice of hotel intercambio pareja algarve portugal protection shall be on the owner of the portugal hotel algarve. ........................................................................................................................................................................
